Why do we need your information?

BICLAS & TRICLAS will process your personal data for the following purposes:


Customer management

BICLAS & TRICLAS is dedicated to the sale of tourist entertainment products, through a physical shop, as well as on its own website and on online sales platforms. The processing of your data is necessary for the performance of the sales or service contract to be concluded between you and BICLAS & TRICLAS. We process and store your personal data to the extent necessary to comply with the applicable contractual and legal provisions. To that extent, personal data processed will be kept for the period necessary to provide the contracted services, as well as to meet tax and legal obligations.


Marketing

BICLAS & TRICLAS may process your data to send you information about its products and services.

This data processing will only be carried out with your consent, given at the time you purchase a product from BICLAS & TRICLAS. If you consent, this means you will be available to receive marketing communications via email and SMS. BICLAS & TRICLAS may also share your data with third parties that manage social networks, such as Facebook, for the purpose of conducting marketing campaigns through social networks.

Consent to the processing of personal data for direct marketing purposes can be revoked at any time.

Your data will be kept for this purpose indefinitely.


Profiling
BICLAS & TRICLAS may perform customer profiling based on information related to your purchases. Whenever you purchase a product or service from BICLAS & TRICLAS, in addition to your personal data, it records the products purchased, amounts paid, date and time, as well as the place of purchase or delivery. In this way, we can actively inform and advise you about our products and services, using appropriate records for this purpose, thus enabling demand-oriented communication and advertising. BICLAS & TRICLAS applies all appropriate measures to safeguard your rights and freedoms in this regard. To this extent, you may at any time exercise your rights and

(I) request clarification of the terms and criteria under which the profile is created;

(II) contest the decisions that will be taken on the basis of automated decisions;

(III) request a human intervention (non-automated).

In the case of the creation of customer profiles exclusively for commercial purposes, you may object to the definition of this profile, to the contacts indicated above.


Shop Video Surveillance

The BICLAS & TRICLAS shop has a video surveillance system, duly marked. The CNPD has declared the processing of personal data resulting from video-surveillance, with the aforementioned limitations, to be adequate, relevant and not excessive, given the stated purpose (cf. 5 of Law no. 67/98, of 26 October, amended by Law no. 103/2015, of 24 August - LPD) and the activity carried out by TRICLA, LDA.

The image recordings obtained by the systems are kept, in encrypted form, for 30 days from the respective capture, after which they are destroyed (without prejudice to the conservation for a longer period in case of legal proceedings).

Will my information be shared with others?
Your personal information is not disclosed to third parties and is only processed within BICLAS & TRICLAS.

Exceptionally, your personal data may be processed by companies outsourced by BICLAS & TRICLAS, namely for website hosting, email, answering users' questions about the services, sending information about new services and products and special offers. Only the personal data necessary for the provision of the service in question shall be provided to these companies.

Your data will be processed within the European Union.

What are my rights?
BICLAS & TRICLAS guarantees all your rights in relation to the processing of your data in accordance with the RGPD, namely: the right to information, the right to rectification of your data, the right to erasure, the right to limitation of processing, the right to object, as well as the right to data portability. In addition, there is the right to lodge a complaint with a data protection supervisory authority under the terms of the GDPR.

You may at any time ask us for a copy of the consents you have granted.

You may at any time revoke the consent given for the processing of your personal data, where the processing is based solely on that consent (e.g. for direct marketing purposes). The same applies to consents given prior to the entry into force of the General Data Protection Regulation, i.e. prior to 25 May 2018. Please note that revocation and opposition are not retroactive, so the processing carried out prior to revocation or opposition will not be affected.


Right of access

The holder of the personal data has the right to obtain from BICLAS & TRICLAS confirmation as to whether or not data concerning him or her is being processed and, where appropriate, to access his or her personal data and access the information provided for by law.

Should you require more than one copy of your personal data being processed, BICLAS & TRICLAS may make this service subject to payment of a fee for the administrative costs.


Right of rectification

The holder of the personal data shall have the right to obtain from BICLAS & TRICLAS, without undue delay, the rectification of inaccurate or incomplete data concerning him or her.


Right to erasure of data

The personal data subject shall have the right to request BICLAS & TRICLAS to erase his or her data without undue delay, and BICLAS & TRICLAS shall be obliged to erase the personal data where one of the following grounds applies, in particular:

a) the personal data are no longer necessary for the purpose for which they were collected or processed;
b) the data subject has withdrawn his/her consent to the data processing (in cases where the processing is based on consent) and there is no other ground for such processing;
c) the data subject opposes the processing and there are no overriding legitimate interests justifying the processing.

Right to restriction of processing
The data subject shall have the right to obtain from BICLAS & TRICLAS the restriction of processing if one of the following situations applies, in particular:

a) he/she contests the accuracy of the personal data, for a period enabling BICLAS & TRICLAS to verify their accuracy;
b) the data processing is lawful and the data subject objects to the erasure of his/her personal data and requests, in return, limitation of their use;
c) BICLAS & TRICLAS no longer needs the personal data for the purposes of processing, but they are required by the data subject for the establishment, exercise or defence of legal claims.
d) has opposed the processing until it is established that the legitimate grounds of the controller override those of the data subject.


Right to data portability
Where processing is subject to the data subject's consent and where that consent has been provided via automated means, the data subject shall have the right to receive the personal data concerning him or her that he or she has provided to BICLAS & TRICLAS in a structured, commonly used and machine-readable format.


Right to object
Where the data processing is carried out for the purposes of the legitimate interests pursued by BICLAS & TRICLAS; or 2) the data processing is carried out for direct marketing purposes; or 3) profiling, the data subject may still object at any time to the processing of his or her personal data.


Can I revoke my consent later?
If consent is legally necessary for the processing of personal data, the data subject has the right to withdraw consent at any time, although this right shall not affect the lawfulness of the processing carried out on the basis of the consent previously given nor the subsequent processing of the same data based on another legal basis, such as compliance with the contract or legal obligation to which BICLAS & TRICLAS is subject.
